
Heh heh heh. Judge Orders Anti-Gun Group to Pay Ammo Companies Legal Fees After Dismissing Lawsuit. Excerpt:
A federal judge has ordered that the Brady Center to Prevent Gun Violence pay the legal fees of an online ammunition dealer in it’s failed lawsuit for the Aurora movie theater shooting.
Issued last week, the order comes after Judge Richard Matsch, who also presided over the Oklahoma City Bombing trial, dismissed the gun control group’s lawsuit aiming to hold Lucky Gunner and other online dealers culpable for the 2012 shooting.
“A crazed, homicidal killer should not be able to amass a military arsenal, without showing his face or answering a single question, with the simple click of a mouse,” said Brady Center’s Legal Action Project Director Jonathan Lowy at the time of the lawsuit. “If businesses choose to sell military-grade equipment online, they must screen purchasers to prevent arming people like James Holmes.”
OK. How? Ask that of the nincompoop Lowy, and the answer will be: Blank-out.
Also: Military arsenal, my middle-aged white ass. My own ammo supply at any given moment far outstrips the supply Holmes accumulated. I’m a perfectly law-abiding citizen who enjoys mornings at the gun club, in the course of which I may burn 4-500 rounds.
Arguing that online ammunition sales are “unreasonably dangerous and create a public nuisance” didn’t play well at all with Judge Matsch as he eviscerated Brady Center’s complaint as pure propaganda.
“It is apparent that this case was filed to pursue the political purposes of the Brady Center and, given the failure to present any cognizable legal claim, bringing these defendants into the Colorado court where the prosecution of James Holmes was proceeding appears to be more of an opportunity to propagandize the public and stigmatize the defendants than to obtain a court order.”
Of course they were trying to propagandize the public. That’s what they do.
Her Royal Highness Hillary I is out on the hustings agitating to remove the legal protection Congress put in place, protecting gun manufacturers from lawsuits stemming from the illegal use of their products. That’s an eminently sensible law, as suing gun manufacturers for the illegal use of their products is exactly equivalent to suing Ford for the actions of drunk drivers.
But the Brady Center decided to try it on ammo distributors, in another egregious act of statist stupidity. Fortunately they ran afoul of Judge Matsch, who actually shows some common sense.
